Electrical contractors are licensed by CSLB in the C-10 Electrical Contractor classification. A C-10 contractor places, installs, erects or connects electrical wires, fixtures, appliances, apparatus, raceways, conduits and solar photovoltaic cells that generate, transmit, transform or use electrical energy. Separately from the contractor license, California certifies the electricians themselves. Certification is required only for people who work as electricians for C-10 licensed electrical contractors, and uncertified people may not do electrical work that requires certification (Labor Code 108.2). The Labor Commissioner says a licensed C-10 contractor does not need to be certified, but employees who work under them do. Its short answer is that all electricians who make connections of greater than 100 volt amps for C-10 contractors must be certified. Certification is not required for work within the scope of a C-7 low voltage or C-45 electric sign license, for registered apprentices in an approved program, or for the qualifying person of a C-10 license (Labor Code 108.2). (source: California Legislature)
Penalties
Contracting without a license is a misdemeanor. A first conviction can bring a fine up to $5,000, up to six months in county jail, or both. A second conviction brings a fine of the greater of $5,000 or 20 percent of the contract price, and at least 90 days in jail in most cases. Charges must be filed within four years (B&P 7028). A C-10 contractor who willfully employs uncertified people to work as electricians can be disciplined, up to suspension or revocation of the license. After a Labor Commissioner referral, CSLB must start any disciplinary action within 60 days. (source: California Legislature)
